These Terms govern access to Auctibuy websites, TikTok Mini App surfaces, APIs, dashboards, seller tools, evaluator desks, escrow workflows, bidding rooms, support tools, and related services. By creating an account, connecting TikTok, listing an asset, bidding, paying a fee, reviewing an item, or using a dashboard, you agree to these Terms and the policies linked from this page.
Agreement to these terms
These Terms govern access to Auctibuy websites, TikTok Mini App surfaces, APIs, dashboards, seller tools, evaluator desks, escrow workflows, bidding rooms, support tools, and related services. By creating an account, connecting TikTok, listing an asset, bidding, paying a fee, reviewing an item, or using a dashboard, you agree to these Terms and the policies linked from this page.
If you use Auctibuy for a company, agency, dealership, evaluator firm, escrow provider, or seller organization, you confirm you have authority to bind that organization. If a transaction-specific checkout, auction room, or written agreement shows stricter rules, the stricter rule controls for that transaction. If you do not agree, do not use Auctibuy or submit bids, fees, documents, or listings.
Relationship with TikTok
Auctibuy is an independent marketplace and auction technology platform. TikTok account, content, developer, and platform use remains governed by TikTok terms, privacy notices, developer rules, app review requirements, and any other TikTok policies that apply to the user or integration.
Auctibuy may use TikTok Login, TikTok content metadata, Mini App packaging, developer APIs, or approved TikTok surfaces when available. Auctibuy does not own TikTok, operate TikTok, or change TikTok account rights. TikTok may independently restrict account access, content availability, embeds, API access, or Mini App approval.
Users must follow TikTok Terms of Service, TikTok Privacy Policy, TikTok Community Guidelines, TikTok Developer Terms, and any applicable TikTok commerce, content, or platform rules. Platform role and no professional advice
Auctibuy provides marketplace technology, auction operations, workflow tooling, review queues, payment hooks, notifications, and support records. Unless a separate signed agreement says otherwise, Auctibuy is not the seller, buyer, broker, lawyer, tax advisor, financial advisor, appraiser, insurer, transporter, title company, lender, escrow company, or government authority for a transaction.
Property, vehicle, antique, regulated product, wholesale, and high-value item transactions may require offline legal transfer, title, registration, tax, customs, import or export, inspection, or authority steps. Evaluator, authenticator, and escrow partner outputs are workflow inputs, not guarantees that an item is lawful, authentic, defect-free, financeable, insurable, or transferable. Users are responsible for independent legal, tax, title, condition, valuation, import or export, and regulatory due diligence before committing to a transaction.
Account eligibility and roles
Auctibuy supports bidder, seller, evaluator, escrow provider, wholesaler, and specialist roles. We may require email verification, payment method setup, KYC, KYB, proof of address, licenses, certificates, sample reports, references, or other compliance files before activating a role.
You must provide accurate account, role, location, business, payment, and compliance information. You must keep credentials secure and immediately report unauthorized access. We may approve, reject, suspend, limit, or revoke role access when information is incomplete, inaccurate, expired, risky, abusive, or legally restricted.
Ratings, completion rate, reviews, KYC/KYB status, evaluator category, escrow eligibility, and transaction history may affect trust score, ranking, badges, and access.
Seller obligations
Sellers must list only assets they can lawfully sell, transfer, and describe. Listing content, photos, proof files, ownership records, legal packs, inspection reports, provenance, vehicle data, property information, authority documents, pricing, timing, and availability must be truthful and current.
You must disclose material defects, liens, finance interests, title limits, restoration, accident history, restrictions, missing documents, authenticity concerns, encumbrances, and known legal issues. You may not list stolen, counterfeit, unsafe, recalled, illegal, embargoed, restricted, or third-party-owned items without authority.
You must cooperate with evaluator, authenticator, escrow, support, buyer, and authority workflows when required. You must honor accepted bids, instant purchase commitments, seller approvals, fee gates, and post-auction settlement instructions.
Bidding, buy-now, and auction integrity
Bids, buy-now actions, bid entry forms, and checkout actions are serious commercial commitments. Auctibuy uses backend-controlled auction state, server-side timing, bid validation, audit logs, valuation ceilings, anti-abuse checks, and payment gates to protect marketplace fairness.
Accepted bids may be binding offers to buy under the rules shown in the auction room. Auctibuy may reject, reverse, or hold bids that are late, duplicated, below increment, above evaluator ceiling, unpaid, suspicious, technically invalid, or policy-breaking. For evaluator-controlled rooms, seller pricing, buy-now pricing, and launch values may be locked to the approved evaluator or authenticator amount.
Do not shill bid, coordinate fake demand, manipulate prices, create false scarcity, use duplicate accounts, harass competitors, or interfere with auction systems.
Evaluator, authenticator, and review workflows
Some categories require review before launch or before buyer access expands. Property, vehicle, antique, bulk, wholesale, regulated, or high-risk rooms may require upfront fees, evaluator selection, appointment scheduling, report upload, seller approval, and launch gate clearance.
Property valuation fees may be flat. Vehicle, antique, art, bulk, and other evaluator fees may be flat or category-specific as shown at checkout. Antique rooms may require authentication grade, authentication score, certificate ID, provenance notes, authenticated value, max approved buyer price, and secondary review status. Global evaluators may appear for property, vehicle, antique, bulk, and general listings when their account is approved for all categories.
Auctibuy may reassign, pause, reject, or require another review if evidence is missing, conflicting, expired, or suspicious.
Fees, deposits, and non-refundable gates
Fees may include listing fees, service access fees, valuation or authentication fees, bid entry fees, buyer escrow activation fees, seller escrow allocation fees, platform fees, payment processor fees, taxes, or partner charges. The exact amount and purpose are shown before payment.
Unless the checkout screen states otherwise, milestone, service access, evaluator, authenticator, listing, and application fees are non-refundable once paid. Payment completion may unlock evaluator search, review assignment, document access, visit booking, bid entry, escrow activation, or launch eligibility. Failed, rejected, cancelled, or incomplete applications do not automatically refund paid service gates unless required by law or expressly stated in writing. Auctibuy may correct pricing or fee display errors before accepting payment or before a room goes live.
Definitions used in these Terms
- Auctibuy means the marketplace technology, brand, software, dashboards, APIs, support tools, workflows, and operating team that make the service available.
- Room means a public, private, draft, review, live, completed, cancelled, hidden, or archived auction listing environment.
- Listing means the asset, content, documents, metadata, pricing, seller representations, photos, videos, proof pack, and workflow state submitted for sale.
- Bid means an offer or attempted offer entered through Auctibuy that is accepted only after backend validation and ledger recording.
- Evaluator means a person or entity approved by Auctibuy to inspect, value, authenticate, verify, or report on a listing category.
- Escrow-style workflow means a controlled settlement handoff, payment hold, document release, financing, title, or closing process that may be operated by Auctibuy, a partner, or an external provider depending on the transaction.
- Governed listing means any listing that requires review, valuation, authentication, proof verification, authority approval, escrow gating, or other controlled workflow before launch or buyer access.
- User Content means listings, messages, reviews, media, documents, profile information, support submissions, evaluation notes, and any other content submitted by users or partners.
Order of documents and transaction-specific terms
Auctibuy may show additional terms inside onboarding, checkout, auction rooms, evaluator assignment flows, escrow workflows, policy pages, fee quotes, seller Studio, support resolutions, or written transaction documents. Those terms operate together with these Terms.
If a checkout screen states a fee amount, purpose, unlock, and non-refundable rule, that checkout disclosure controls the payment you are making. If an auction room states bid increments, bid entry requirements, timing, payment window, or valuation ceiling, the room rules control that auction. If a signed written agreement with Auctibuy covers enterprise, evaluator, escrow, merchant, agency, or partner use, that signed agreement controls where it conflicts with these public Terms. If TikTok, a payment processor, escrow provider, bank, logistics provider, registry, title office, customs authority, court, regulator, or local law imposes stricter rules, those stricter rules may also apply.
Commercial capacity and high-value transactions
Auctibuy is designed for commercial marketplace activity, including property, vehicles, antiques, art, bulk inventory, regulated products, wholesale lots, and other high-value assets. Users must have legal capacity and authority to enter these transactions. Do not bid, list, evaluate, authenticate, approve, or settle a transaction if you are not legally allowed to do so.
If you act for a company, dealership, owner, estate, agency, evaluator practice, escrow provider, wholesaler, or merchant, you represent that you have authority to act for that entity. High-value assets may involve legal title, taxes, registration, customs, cultural property rules, export controls, sanctions, financing, liens, inheritance, matrimonial property, beneficial ownership, or authority restrictions outside Auctibuy. Auctibuy may require proof of authority, beneficial ownership, seller mandate, trade license, professional credentials, or other records before activating a listing or account role.
Category-specific listing rules
Different listing categories carry different risks and may require different information, fees, review steps, and launch gates. Auctibuy may classify or reclassify a listing when the evidence, item type, value, geography, or risk profile requires it.
Property listings may require location, title proof, seller authority, legal pack, valuation, visit windows, escrow-style closing, and seller approval before publication. Vehicle listings may require make, model, year, registration, chassis or VIN where lawful, ownership proof, condition disclosure, accident or finance disclosure, and evaluator review where required. Antique, art, and collectible listings may require provenance, period estimate, material composition, ownership chain, restoration history, authenticity score, certificate ID, and evaluator or authenticator approval. Bulk and wholesale listings may require invoices, trade license, inventory records, quantity, condition, provenance, and buyer eligibility checks. General merchandise may still be escalated to governed review if it appears high-value, regulated, branded, restricted, risky, or frequently abused.
Seller representations and continuing duties
By submitting or maintaining a listing, the seller makes ongoing representations from submission through settlement. These representations are repeated every time the seller edits the listing, pays a fee, accepts a valuation, approves launch, communicates with a buyer, or completes settlement.
The seller has the right to sell or is authorized by the lawful owner to sell. The listing description, photos, proof files, ownership records, legal packs, inspection reports, provenance, vehicle data, property information, authority documents, pricing, timing, and availability must be truthful and current. The seller has disclosed liens, finance interests, title restrictions, ownership disputes, defects, restoration, damage, authenticity concerns, legal restrictions, and material facts known to the seller. The seller will not move the item off-platform to avoid fees, auction records, escrow controls, evaluator reports, or buyer protections after using Auctibuy to source demand.
The seller will cooperate with inspection, buyer visit, proof verification, transfer, payment, delivery, title, escrow, and support requirements.
Buyer and bidder representations
By bidding, paying an entry fee, unlocking documents, requesting a visit, starting escrow, using instant purchase, or completing checkout, a buyer makes serious commercial representations.
The buyer is using a real account, accurate identity information, and an authorized payment method. The buyer understands that bids may be binding once accepted by Auctibuy backend systems and may create a duty to complete checkout if the buyer wins. The buyer will conduct due diligence, review available reports, ask necessary questions, and understand the item before bidding. The buyer will not collude, shill bid, manipulate prices, harass sellers, evade bid entry fees, bypass escrow controls, or use another person account or payment method without permission.
The buyer accepts that entry fees, document unlocks, service gates, escrow activation fees, and similar milestone fees may be non-refundable as displayed.
Evaluator, authenticator, and specialist duties
Evaluators, authenticators, appraisers, inspectors, and specialist reviewers must meet higher conduct standards because their work may control launch eligibility, pricing ceilings, buyer confidence, and settlement decisions.
Specialists must accurately select their coverage: property, vehicle, antique, global, bulk, or other approved category. Specialists must disclose conflicts of interest, financial relationships, seller affiliations, buyer affiliations, prior ownership, referral payments, or anything that could affect independence. Specialists must not accept off-platform compensation to inflate, suppress, delay, or manipulate a valuation or authentication result.
Reports must be based on the evidence reviewed and should identify assumptions, limitations, missing records, inspection method, market comparables where relevant, and reasons for the conclusion. Auctibuy may audit specialist activity, withhold assignments, require re-review, remove specialist status, or report misconduct.
Auction launch gates and review control
A listing is not entitled to go live merely because it was submitted or a fee was paid. Launch depends on backend status, payment state, required documents, seller profile completion, evaluator or authenticator review where required, platform risk checks, and final system approval.
A room may remain draft, under review, awaiting payment, awaiting evaluator, awaiting report, awaiting seller approval, ready to launch, live, completed, rejected, hidden, or cancelled. For governed listings, Auctibuy may block launch until appointment completion, report upload, evaluator approval, seller acceptance of valuation, and locked pricing are all satisfied. When a valuation ceiling applies, opening bid, reserve, buy-now, or launch price settings may be rejected if they exceed or bypass the approved value. Auctibuy may waive, require, or re-open review steps when the category, value, documents, or risk profile changes.
Auction timing, extensions, and system authority
Auctibuy backend systems, not user devices, control auction timing and status. Live display, cached state, browser clocks, screenshots, or local app state may lag behind the backend ledger.
Auctibuy may use server timestamps, anti-sniping extensions, queue ordering, idempotency keys, and audit logs to decide whether a bid was timely and valid. If there is a technical outage, payment failure, realtime delay, suspicious bidding pattern, or legal concern, Auctibuy may pause, extend, restart, cancel, hide, or manually review an auction. If a display error shows an incorrect price, timer, bid, seller, valuation, fee, or status, Auctibuy may correct the error before settlement. Auctibuy may refuse to honor obviously erroneous bids, prices, or room states where enforcement would be unfair, unlawful, or commercially unreasonable.
Payment authorization, taxes, chargebacks, and failed payments
Users authorize Auctibuy and its payment providers to create charges, holds, confirmations, refunds, reversals, and payment records for the purposes shown in checkout or transaction workflows.
Users are responsible for taxes, duties, registration fees, transfer fees, bank fees, card fees, currency conversion, customs, shipping, storage, and third-party provider charges unless a transaction document says otherwise. Auctibuy may require payment method setup before bidding, listing, escrow, document access, or winner checkout. Auctibuy may suspend or limit accounts for failed payments, chargebacks, unauthorized payment disputes, suspected fraud, or unpaid balances. If a payment is reversed after access, review, or services were delivered, Auctibuy may recover the amount, restrict accounts, cancel benefits, or pursue remedies allowed by law.
Escrow, financing, title, and release workflows
Escrow-style workflows are operational controls for settlement. They do not automatically mean Auctibuy is a licensed escrow agent, bank, lender, broker, title company, or regulated financial institution unless a separate written disclosure states that role for a specific transaction.
Auctibuy may route records, approvals, payment status, documents, and release instructions to external escrow, payment, title, financing, bank, legal, or compliance providers. External providers may impose separate identity checks, fees, application review, timelines, rejection rights, hold periods, and dispute rules. Seller escrow allocations, buyer escrow activation fees, financing requests, and application charges may be non-refundable even if a later application is rejected, where disclosed before payment and allowed by law. Auctibuy may delay release for chargebacks, fraud, sanctions, title disputes, ownership concerns, document defects, legal requests, buyer or seller disputes, or provider instructions.
Ratings, reviews, trust scores, and verification badges
Auctibuy may collect ratings and written feedback from buyers, sellers, evaluators, escrow providers, wholesalers, and other transaction participants. Ratings are part of the trust system, not a guarantee of future performance.
Ratings and reviews may affect public profiles, search ranking, trust score, verification badge eligibility, dashboard summaries, and marketplace access. Auctibuy may require feedback before a transaction is marked completed. Auctibuy may remove, hide, down-rank, or investigate reviews that are fake, abusive, retaliatory, paid, conflict-driven, irrelevant, privacy-invasive, discriminatory, or manipulated. Auctibuy does not guarantee that ratings are complete, objective, or free from bias, though it may use controls to improve reliability.
User content license and marketplace display
Users retain ownership of content they submit, subject to rights granted to Auctibuy and other transaction participants as needed to operate the marketplace. By submitting User Content, you grant Auctibuy a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, distribute, adapt for formatting, translate, analyze, moderate, and use that content to operate, improve, secure, market, and support Auctibuy.
This license includes listing photos, videos, descriptions, proof packs, reports, profile details, messages, reviews, and support submissions where needed for product operation. Auctibuy may create thumbnails, previews, compressed versions, watermarked displays, search snippets, audit copies, and backup copies. You represent that you have rights to upload the content and that it does not violate intellectual property, privacy, publicity, confidentiality, TikTok, platform, or legal rights.
Auctibuy may remove or restrict content without notice when it appears illegal, unsafe, infringing, misleading, restricted, privacy-invasive, or policy-breaking.
Intellectual property and platform ownership
Auctibuy software, branding, designs, workflows, text, dashboards, code, databases, logos, icons, trade dress, algorithms, documentation, and non-user content are owned by Auctibuy or its licensors. Users receive only a limited, revocable, non-transferable right to use the service as allowed by these Terms.
Do not copy, scrape, reverse engineer, resell, sublicense, frame, mirror, or commercially exploit Auctibuy software or data except through approved product functionality. Do not remove proprietary notices, bypass access controls, interfere with security, or use Auctibuy marks in a way that suggests endorsement without written permission. Feedback, feature requests, ideas, bug reports, and suggestions may be used by Auctibuy without compensation or restriction.
Prohibited use and platform abuse
Users must not misuse Auctibuy, TikTok-connected functionality, payment systems, review flows, support tools, or marketplace communication.
No fraud, money laundering, sanctions evasion, terrorist financing, fake identities, stolen payment methods, stolen goods, counterfeit goods, document forgery, or illegal trade. No scraping, credential stuffing, bot activity, denial-of-service activity, malware, vulnerability exploitation, unauthorized API access, or attempts to bypass rate limits or security controls. No harassment, threats, hate, doxxing, extortion, impersonation, fake reviews, off-platform fee evasion, bid manipulation, collusion, or retaliation. No use of TikTok content, creator identity, music, media, or platform references in a way that violates TikTok rules, creator rights, or applicable law.
Sanctions, export controls, and restricted regions
Users may not use Auctibuy in violation of sanctions, export controls, anti-money laundering rules, anti-bribery laws, customs restrictions, cultural property restrictions, import or export rules, or other trade controls. Auctibuy may block countries, regions, users, assets, payment methods, or transactions when required or when risk is unacceptable.
Users must not list, buy, sell, ship, finance, or settle assets involving sanctioned persons, restricted territories, embargoed goods, illegal export, or prohibited cultural property transfer. Auctibuy may require additional information about beneficial owners, source of funds, source of wealth, origin of goods, destination, or transaction purpose. Auctibuy may reject or freeze workflows while screening or legal review is pending.
Third-party services and external platforms
Auctibuy integrates or links with third-party services such as TikTok, hosting providers, payment processors, email services, storage services, analytics, fraud tools, escrow providers, financing providers, registries, title offices, map services, and support tools. Those services are not controlled by Auctibuy and may have their own terms, policies, fees, outages, restrictions, and decisions.
Auctibuy is not responsible for third-party downtime, account restrictions, API changes, payment declines, processor holds, bank delays, content takedowns, or external provider errors outside Auctibuy control. Users must comply with third-party terms when using those services through or alongside Auctibuy. Auctibuy may replace, suspend, or remove integrations when provider access changes or risk requires it.
Beta, sandbox, mock, and demo features
Some features may be experimental, sandboxed, simulated, mock, demo, or pending external approval. Labels, environment banners, or support documentation may identify these features, but users should not assume every workflow is production settlement-ready unless the product states it clearly.
Sandbox payment flows may save mock payment methods or generate test ledger events without moving real money. Demo listings, seeded uploads, local development accounts, and mock users are for testing and may be reset, removed, or hidden. Auctibuy may disable beta features, delete test data, change behavior, or restrict access without liability.
Suspension, termination, and account closure
Auctibuy may suspend, restrict, downgrade, terminate, or refuse service to any account, role, listing, bid, payment, evaluator, seller, buyer, escrow provider, or partner when necessary to protect the platform, users, partners, legal compliance, or marketplace integrity.
Reasons may include fraud risk, document concerns, abusive conduct, repeated failed payments, chargebacks, prohibited items, legal requests, policy violations, suspicious bidding, or incomplete KYC/KYB. Termination does not erase obligations already incurred, including payment obligations, dispute cooperation, confidentiality, indemnity, audit retention, or settlement duties. Auctibuy may preserve records after closure where needed for fraud prevention, legal compliance, tax, payment, audit, chargeback, dispute, safety, or legitimate business purposes.
Indemnification
To the maximum extent allowed by law, you agree to defend, indemnify, and hold harmless Auctibuy, its affiliates, officers, directors, employees, contractors, service providers, and agents from claims, losses, liabilities, damages, penalties, costs, and expenses arising from your use of Auctibuy, your listings, your bids, your content, your documents, your breach of these Terms, your violation of law, your infringement of rights, your transaction disputes, or your misconduct.
This includes reasonable legal fees and investigation costs where recoverable by law. Auctibuy may control the defense of matters affecting platform operations, intellectual property, security, policy enforcement, or regulatory posture. You may not settle any claim in a way that admits fault by Auctibuy, imposes obligations on Auctibuy, or affects Auctibuy rights without written consent.
Escrow-style and settlement workflows
Some closings may route through escrow-style handoff, financing review, external escrow providers, title or transfer checks, payment holds, release approvals, dispute handling, or offline settlement. Escrow availability depends on category, region, partner approval, buyer action, seller configuration, and risk controls.
Auctibuy may facilitate workflow records and notifications without itself holding funds unless expressly stated. External escrow, payment, bank, financing, title, transport, or authority partners may impose additional terms and verification requirements. Settlement may be paused for identity, fraud, chargeback, title, legal, safety, sanctions, regulatory, or documentation concerns.
Disputes, moderation, and enforcement
Auctibuy may investigate listings, accounts, bids, payments, messages, documents, reviews, transactions, support tickets, and audit logs. We may hide, pause, reject, cancel, limit, or escalate activity when needed to protect users, comply with law, preserve platform integrity, or satisfy partner requirements.
We may require additional documents, seller follow-up, buyer proof, evaluator clarification, payment verification, or authority review. We may remove reviews, ratings, listings, or profile content that is false, abusive, retaliatory, illegal, privacy-invasive, or manipulated. We may cooperate with payment processors, TikTok, regulators, courts, law enforcement, rights holders, and safety partners when legally required or reasonably necessary.
Liability limits and no guaranteed outcomes
To the maximum extent allowed by law, Auctibuy is provided as a platform and workflow service. We do not guarantee uninterrupted access, auction outcomes, sale completion, buyer payment, seller delivery, evaluator accuracy, escrow approval, asset condition, title transfer, investment value, or availability of TikTok, payment, hosting, communications, or third-party systems.
Auctibuy is not liable for indirect, incidental, consequential, special, punitive, lost profit, lost data, lost opportunity, or reputational damages where such limits are allowed. Nothing in these Terms limits liability that cannot legally be limited, including liability for fraud where applicable law prohibits exclusion. Some regions do not allow certain exclusions, so local mandatory rights may apply. These liability provisions must be reviewed by qualified counsel before production launch in each operating jurisdiction.
Dispute process and operational remedies
Auctibuy may provide support, investigation, mediation-style workflow tools, payment evidence, evaluator clarification, escrow notes, audit logs, and account records to help resolve marketplace disputes. Auctibuy does not guarantee a favorable outcome and may decide platform remedies separately from legal remedies available to the parties.
Users must report disputes promptly with room ID, transaction ID, payment reference, timeline, documents, screenshots, communications, and requested outcome. Auctibuy may request additional evidence, pause settlement, restrict listing visibility, hold launch, block further bids, reopen evaluator review, or escalate to a provider.
Platform remedies may include cancellation, relisting, account restriction, rating adjustment, document unlock reversal, support note, payout delay, refund review, or referral to external authorities. Auctibuy may decline disputes that are unsupported, abusive, stale, outside platform records, already resolved, or better handled by a court, regulator, payment processor, or external escrow provider.
Governing law, venue, and mandatory rights
Because Auctibuy may operate across regions and through TikTok-connected experiences, governing law and venue may depend on the contracting Auctibuy entity, user residence, asset location, transaction documents, and mandatory local law. Where Auctibuy publishes region-specific terms or signs a transaction-specific agreement, those terms identify the controlling forum where required.
Nothing in these Terms removes consumer, privacy, payment, employment, property, or statutory rights that cannot legally be waived. Where arbitration, class action waiver, small claims, regulatory complaint, or court venue language is required for a region, Auctibuy may publish a region-specific addendum for that market. Users remain responsible for following the laws that apply to their account, asset, bid, sale, review, payment, export, import, registration, and settlement. Region-specific addenda may identify the contracting entity, governing law, dispute forum, arbitration terms, consumer-rights notices, tax disclosures, and authority requirements that apply to a particular market.
Electronic communications and notices
Auctibuy may communicate through the product, email, push notification, SMS where enabled, dashboard banners, support messages, transaction pages, evaluator notes, escrow notes, or public policy updates. Users consent to electronic communications for operational, legal, security, payment, and transaction notices where allowed by law.
You must keep your email, phone where provided, TikTok-linked identity, payment profile, and account information current. A notice sent to the contact information or dashboard associated with your account may be treated as delivered even if you do not read it promptly. Marketing messages may be controlled separately where opt-out rights apply, but transactional and legal notices may still be sent.
Force majeure and events outside our control
Auctibuy is not responsible for delay or failure caused by events outside reasonable control, including network failures, hosting failures, payment network outages, TikTok API or platform restrictions, natural disasters, labor disruption, war, terrorism, civil unrest, epidemics, government action, legal orders, power failures, cyberattacks, supply chain disruption, or third-party provider failures.
Severability, waiver, and assignment
If any part of these Terms is found unenforceable, the remaining parts continue to apply to the maximum extent allowed. Auctibuy failure to enforce a term immediately is not a waiver. Users may not transfer accounts, listings, bids, roles, ratings, or obligations without permission. Auctibuy may assign or transfer these Terms in connection with a merger, acquisition, financing, restructuring, asset sale, or operation of the service.
Entire agreement for public platform use
These Terms, the Privacy Policy, Community Guidelines, Auction Rules, Payments and Fees Policy, Prohibited Items Policy, Data Retention Policy, TikTok Platform Addendum, and any transaction-specific disclosures form the public agreement for ordinary platform use. They replace prior public statements about the same subject unless a signed agreement says otherwise.
Changes to terms
We may update these Terms to reflect product changes, fee models, legal requirements, TikTok platform changes, payment provider requirements, security controls, or operational lessons. Material updates will be posted with an updated date. Continued use after an update means acceptance of the updated Terms, except where law requires a different process.
